General Terms and Conditions of Sales and Use of the Website
1 Object
These general conditions of sale and use of the website shall apply without restrictions both on digital products, whether a fee is charged or not, and services provided by Stratwex on its website to any individual or legal entity, organization or institution, hereinafter referred to as ” The Buyer “, as well as on the use in general of the website www.stratwex.com.
Stratwex is a company registered with Banque Carrefour des Entreprises under the number 0561.779.854 hereinafter referred to as ” The Seller ” and whose address is Rue des Colonies 11 1000 Brussels, Belgium.
Stratwex is a registered trademark owned by Thierry Barbier.
Any transaction, with or without payment, via this site implies acceptance without exceptions or reservations by the Buyer of these General Conditions of Sales.
The Seller reserves the right to modify terms and conditions at any time. In this case, the applicable conditions are those in effect on the date of the order by the Buyer.
2 Prices
The total prices of digital products (videos) or services displayed and sold on the site are in Euros and include all taxes. VAT, where applicable, will be applied at the rate in effect and in accordance with the rules of VAT effective at the time of the transaction.
The Seller reserves the right to change prices at any time. However, the prices applicable to the orders are those in effect at the time of confirmation of orders.
3 Videos
Access to paid videos will be granted using the access codes provided by the Seller after payment. The period for access will be the one specified before confirming the order. The access codes will be deactivated after this period.
4 Personal use
The access codes supplied to the Buyer are strictly personal and confidential and under the exclusive responsibility of the Buyer. They may not be transferred or sold or shared with any other person or entity.
The Buyer shall guarantee that clause and answer for any fraudulent or abusive use of the provided access codes.
In case of noncompliance with this clause, the Seller reserves the right to deny access to the service to the Buyer without notice or compensation.
Playing the video to a group of people is strictly prohibited, except with the agreement and under the terms of the Seller.
5 Guarantee and limitation of liability
The Seller shall make every effort to provide access to its digital products 24/7 for the period allowed to the Buyer.
The Buyer shall take all necessary measures to ensure that the technical characteristics of the device used (computer etc.) allow proper access to the service and shall take all appropriate measures to protect his/her own data and/or software from contamination by viruses or any malware possibly circulating through the website.
The Seller’s liability cannot be incurred for any inconvenience or damage arising from the use of the Internet and access to the website, including a break in service, external intrusion or the presence of viruses or malware.
In the event of a break of service or technical problems of the Internet network or website shutdown or failure, the Buyer agrees not to claim compensation or damages to the Seller. However, if the interruption is due to technical problems that are clearly on the side of the Seller, in the case of failure of the website or its webhosting service for example, the Buyer, by request via email, may require a corresponding extension of the period of service access.
Any warranty is excluded in case of misuse, viruses or malware, neglect or lack of appropriate and suitable physical device and software from the Buyer, as well as in case of accident or force majeure. The Buyer acknowledges that the Seller has only an obligation of means.
In all cases, the warranty is limited to the amount actually paid for the service.
The products and services sold on this website comply with Belgian regulations. The Seller’s liability cannot be incurred for noncompliance with the legislation of the country where the products and services are available. The Buyer shall take responsibility for checking the compliance with local laws and regulations.
6 Orders
Unless proven otherwise, the data provided by the Buyer and recorded by the Seller constitute proof of contract elements and modalities governing the relationship between the Seller and Buyer.
The sale will be considered final after sending the Buyer an email confirming the order and including the access keys.
7 Payment
Validation of the order by clicking on the payment button implies for the Buyer to pay the quoted price.
8 Right of withdrawal
According to the law, the Purchaser has no right of withdrawal for videos for the following reasons: it is a digital content not supplied on a tangible medium; the Buyer, consenting for the execution during the withdrawal period, acknowledges that the right of withdrawal is lost.
In terms of pure service, not digital and not including a digital product or service, the Purchaser has a period of 14 days to exercise his right of withdrawal. The Buyer must simply notify the Seller by email and the Buyer will be refunded the amount corresponding to the service provided that the Buyer has not requested the execution of the service before the end of the withdrawal period.
9 Claims
The Buyer may submit any claim by contacting the Seller by telephone, email or mail.
10 Intellectual property rights
Trademarks, domain names, products, software, images, videos, texts are and remain the exclusive property of the Seller.
Unless otherwise agreed by the Seller, any total or partial reproduction, distribution, modification or use of such property for any reason is strictly prohibited.
11 Force majeure
The Seller’s obligations to the terms hereof shall be suspended upon the occurrence of a fortuitous event or force majeure that prevents the execution.
12 Protection of personal data
The use of personal data of the Buyer by the Seller is subject to the Belgian Law of December 8 1992 as amended by Act of December 11 1998 on the protection of personal data.
By adhering to these General Terms and Conditions of Sales, the Buyer accepts the use of personal data for the completion of this contract.
13 Applicable law
These General terms and Conditions of Sales are governed by Belgian law.
They are written in French. When they are translated into one or several languages, only the French text will prevail in case of dispute.
In case of dispute between the Seller and the Buyer and after the failure of all negotiations and mediation, the Brussels court shall have exclusive jurisdiction.
